Another x2 teir upload stuck at 40mb upload

after upgrading to x2 from gig plus, I saw that I needed a modem from xfinitys list, so I bought a netgear cm3000.

I got it activated but still getting 40 upload (download is good at 2300)

multiple restarts, no change
